Seismique Sugar Skull Design Competition Official Rules
1. Eligibility
- The competition is open to all who wish to participate.
- Entrants must use the official masks provided by Seismique for their designs. Masks are available for pickup at Seismique, 2306 S Texas 6, Houston, TX 77077.
- Each entrant is permitted to submit one (1) mask. The first mask is provided free of charge; additional masks are available for $5 plus tax each if you wish purchase additional masks for trial or drafts.
2. Design Requirements
- Participants may decorate their masks using any media of their choice, including paint, markers, or other materials.
- Entrants may choose to enhance their masks with additional decorations (e.g., sequins, beads, etc.), but this is optional.
- All designs must be original and appropriate for public display. Any masks featuring inappropriate content, including explicit images or language, will be disqualified.
3. Submission Guidelines
- Completed masks must be submitted no later than 4:00 PM on October 21, 2024.
- All submissions should be hand-delivered to Seismique at 2306 S Texas 6, Houston, TX 77077.
- Late submissions will not be accepted nor considered for prizes.
- Each submission must be accompanied by a signed submission form, providing the entrant’s name and contact information. By signing, the entrant attests that they personally designed and created the artwork and that they agree to the competition’s terms and conditions.
- Entrants under the age of 18 must also have their submission form signed by a parent or guardian.
4. Judging Criteria
- Masks will be evaluated based on three primary criteria: creativity, artistic skill, and overall aesthetic appeal.
- The judging panel, composed of Seismique staff, will have the sole authority to select winners. All decisions made by the judges are final.
- Entrants are eligible to win only one prize.
5. Prizes
- First Prize: $1,000, two free tickets to Seismique, and a Seismique swag bag.
- Second Prize: $500 and two free tickets to Seismique.
- Third Prize: $250 and two free tickets to Seismique.
- Prizes are non-transferable and must be claimed by the winning entrants.
6. Exhibition and Retrieval
- Seismique reserves the right to display submitted masks for public viewing as part of the competition or in future exhibits.
- Masks may be retrieved by participants between November 4 and November 10, 2024, during Seismique’s normal business hours.
- Masks not collected by November 10, 2024, will become the property of Seismique, which reserves the right to dispose of them if necessary.
7. Usage Rights
- By submitting their artwork, participants grant Seismique the right to use their submitted masks solely for display, marketing, and promotional purposes related to the competition, this art exhibition, and any future Seismique art exhibitions.
- This usage includes, but is not limited to, Seismique press releases, event presentations, articles, graphics, slideshows, presentations, event materials, and use on the Seismique website.
8. General Conditions
- In the event that the operation, security, or administration of the Competition is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problems, or if the Competition is unable to run as planned for any other reason as determined by Seismique in its sole discretion, Seismique may, in its sole discretion, either (a) suspend the Competition to address the impairment and then resume it in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Competition and, in the event of termination, refund all entry fees paid.
- Seismique reserves the right in its sole discretion to disqualify any individual found tampering with the entry process or the operation of the Competition, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
- Any attempt by any person to damage or undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and Seismique reserves the right to seek damages (including attorney’s fees) and other remedies from such individuals to the fullest extent permitted by law.
- Failure by Seismique to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
9. Release and Limitations of Liability
- By participating in the Competition, entrants agree to release and hold harmless Seismique, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Competition, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of the prize (including any travel or activity related thereto).
- This includes, but is not limited to: (a) unauthorized human intervention in the Competition; (b) mechanical, network, electronic, computer, human, printing, or typographical errors; (c) any other errors or problems in connection with the Competition, including errors in the administration of the Competition, the announcement of winners, the cancellation or postponement of the event, or in any Competition-related materials; or (d) injury, death, losses, or damages of any kind, to persons or property, which may be caused, directly or indirectly, from entrant participation in the Competition or acceptance, receipt, or misuse of the prize.
- Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Competition, and in no event shall the entrant be entitled to receive attorney’s fees.
- Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Competition. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
10. Disputes
- Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas.
- All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of Seismique in connection with the Competition, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Texas.
11. Privacy
- Information collected from entrants is subject to Seismique’s privacy policy.
12. Inclusion in Competitions
- To be included in any and all competitions, participants must agree to and adhere to the above-listed rules.
13. Changes in Rules
- All provisions, including pricing, fees, prizes, requirements, and rules, may change without notice.
